THE Patriotic Front (PF) has asked the High Court not to entertain an application for injunction stopping the party from expelling former Chongwe Member of Parliament Sylvia Masebo saying it is an abuse of the court process as she is no longer a member.
This is contained in an affidavit in opposition of application for injunction filed in the High Court by PF secretary general Davis Chama.
“I crave this court to refuse to entertain the application and to dismiss it for lacking merit and for being an abuse of the process of court,” he said.
Mr Chama argues that Ms Masebo was expelled from the party last month for gross misconduct and that the Speaker of the National Assembly was notified.
He said Ms Masebo was suspended from the party in December last year and was given 30 days in which to exculpate herself but that instead of doing so, she showed no remorse and continued to conduct herself insolently.
Mr Chama alleged that Ms Masebo decided to support United Party for National Development (UPND) president Hakainde Hichilema in the January 20 elections this year, and that she did so by de-campaigning PF president Edgar Lungu.
He said Ms Masebo’s actions were aimed at pouring scorn on the party and President Lungu and that these acts attracted expulsion from the party.
“The plaintiff cannot be seen to seek protection from the courts of law as she perpetually violated the electoral code of conduct and the defamation Act,” Mr Chama said.
Mr Chama added that Ms Masebo’s application for injunction has no merit because even if it was granted, it would be academic as she is no longer a member of the PF.
Ms Masebo has asked the High Court for an order of interim injunction restraining the PF from expelling her from the party.
