A SIX-YEAR-OLD girl has narrated before the Chingola Magistrate Court how a 23-year-old man who indecently assaulted her threatened to kill her when she attempted to shout for help.
Before Magistrate Penstone Chiluba, was Michael Phiri, 23, of house number 40 Kanongesha Road, Chiwempala township, who is facing one count of indecent assault of a child contrary to the Laws of Zambia.
Narrating the ordeal, the girl who identified the accused, testified that she was on her way home with her friend when she met the accused who called her and asked her to enter into a room which she discovered was a toilet.
“I was going home when he called me and told me to call Peter but I did not know him [Peter] then.
After entering the room, I discovered that it was a toilet and he closed the door. He told me to take off my clothes and threatened to kill me if I was going to shout for help,” she said.
The girl told the court that the accused covered her mouth with his hand and undressed her.
“He started kissing me but my aunt came in and he ran away,” She said.
Particulars of the offence are that Phiri, on May 31this year, unlawfully and indecently assaulted a girl aged six in Chingola.
In his ruling, Mr Chiluba found the accused with a case to answer and put him on his defence.
“Looking at the evidence on record, I am satisfied that a prima facie case has been established against you, I, therefore, put you on your defence so that I hear from you, “Magistrate Chiluba said.
The matter has been adjourned to August 4, 2015 for defence.
