A notice of motion for the impeachment of President Edgar Lungu for alleged violation of the constitution and other laws of the republic and gross misconduct has been filed with Speaker of the National Assembly Patrick Matibini. .
The notice of motion is being spearheaded by UPND parliamentary Whip Garry Nkombo and seconded by PF Roan Member of Parliament Chishimba Kambwili is being supported by one third of the Members of Parliament.
They are urging the house to resolve to impeach the President for violation of the constitution and other laws and gross misconduct and upon adoption of the motion by the house a tribunal be established to investigate allegations leveled and to render a report to the Chief Justice pursuant to Article 108 (5)(b) of the constitution.
The grounds of the impeachment motion are that the President violated the provisions of Article 104(3) of the Constitution during the period 19th August, 2016 to 5th September,2016 when he, as incumbent President and President-elect,refused,failed or neglected to hand over executive functions to the Speaker of the National Assembly during the pendency of the Presidential petition in the Constitution court.
They have also alleged that the President violated the provisions of Article 104(3) of the Constitution during the period 19th August,2016 to 5th September 2016 when he purported to exercise executive power contrary to Article 104(3).
They further allege that the President violated the Provisions of Article 122 of the Constitution on 2ndNovember 2017 when he interfered with the independence of the Judiciary in a speech made upon his arrival at Solwezi Airport when he made statements directed at the Constitutional Court in relation to a matter that pending before the court in which his eligibility to contest the 2021 presidential election is under consideration.
