20 years prison with hard labor, for defiling and infecting niece with STD

A 21-year old man of Mpulungu District has been sentenced to 20 years imprisonment with hard labor, for defiling and infecting his 8-year old niece with a sexually transmitted infection.

Appearing before the Kasama High Judge Mary Mulanda was Emmanuel Musonda who was charged with one count of defilement.

Facts before the court were that on unknown dates, but between February and April 2013, Emmanuel Musonda had carnal knowledge of his niece.

Judge Mulanda said she was satisfied with the prosecution witnesses who established sufficient evidence that the convict defiled and infected her niece with syphilis.

In mitigation Emmanuel Musonda through his Legal Aid Lawyer pleaded for leniency.

But Judge Mulanda said she had exercised maximum leniency by imposing a 20 years’ imprisonment and that the sentence would be a deterrent to would-be offenders.
