Judge Justice Gaudencia Salasini fined Nyambe the K 3000 for causing the death of two persons from the same family.
The incidence happened on 1st February, 2013 around 17:00hrs when the accused person was driving a corolla registration number ACH 8095 along Nakatindi road in Kazungula District of Southern Province.
The accused person is said to have been driving in a dangerous manner to the public and ran over Lovely Like and Purity Like who sustained injuries and died on the spot.
The accused was arrested on the same day. The deceased persons were taken to the Livingstone general hospital mortuary were a postmortem was done and results indicated that severe head injuries and internal bleeding which led to the death of the two victims.
Mr. Nyambe admitted the charge and acknowledged that he did not have lawful justification for his actions.
In passing judgment Justice Salasini exercised lenience on the accused as he was a first offender and fined him three thousand kwacha, of which two thousand kwacha was going to the bereaved family and one thousand kwacha to the state.
Mr. Nyambe was warned that the fine should be paid in five days, failure to which he would be imprisoned for three months.
Meanwhile, justice Salasini has also suspended the Mr. Nyambe’s driving license.
ZMW 3,000 seems a small price. In the UK dangerous driving is equated with being in public with a weapon, like a gun. You know full well you could kill someone. It is therefore more heavily punished than say manslaughter.
