A Lusaka man has been sued for adultery in a Local Court in Lusaka for sending love messages to a married woman.
This is in a case in which Given Mweemba, 28, a driver of Zanimuone compound sued Collins Mweemba, 48, of the same compound for allegedly committing adultery with his wife, Maureen Silomba.
Given told Senior Court Magistrate Pauline Newa sitting with Magistrate Lewis Mumba at Matero Local Court that as a driver he spent most of his time away from home, so he set his wife’s phone on auto-recording without her knowing.
After two months he found love conversation between his wife, Maureen and Collins.
He explained that the recordings clearly showed that his wife and Collins were in a steamy relationship.
Given further informed the court that one of the recording suggested that Collins was a good lover since he told Maureen that ‘Nizakupasa yonse yamene ufuna’ meaning “I will give it to you the way you want.”
Given further said that in one of the messages Collins said he was in love with Maureen and that he would buy her relish which tasted so nice like her.
“I did not understand what that message meant but I was sure that the two were lovers. I need to be compensated because Collins knew that Maureen was married to me and this brought differences in our matrimonial home,” said Given.
In defence, Collins denied all the allegations and said that his messages were mere jokes as Maureen was his friend.
Maureen testified that she was never in a relationship with Collins because she was already married to Given.
She said she allowed Collins’ calls and messages because he bought her fish and meat on certain occasions.
Magistrate Newa said it was clear that Mweemba and Maureen had an affair and that was the reason he bought fish and meat for her.
She said even if the two could not have had sex, it was clear that they were in the process of committing adultery.
The court ordered Collins to compensate Given with K8,000.
