The Luwingu District Subordinate Court has committed a 72 year old man of Katuta Village in chief Katuta’s area to the High Court for sentencing after he was found guilty of defiling a 4 year old girl.
Particulars of offence before Magistrate Davy Simfukwe are that David Kasenge had carnal knowledge of the named girl on 16th December 2013 in a grass thatched bathroom.
But, in his defence embattled Kasenge told the court that he did not penetrate into the girl, but merely released sperms on the minors’ thighs.
However, Magistrate Simfukwe stated that the prosecution team proved beyond reasonable doubt that David Kasenge defiled the girl.
