Food Lovers sued for breach of contract

FOOD Lovers Lusaka has been sued by two firms for breach of contract involving over K1 million.

The food chain has been sued by Embassy Supermarket and Butchery Limited for loss and damage for failing to meet its contractual obligations when it agreed to buy the supermarket and butchery.
According to the statement of claim filed in the Lusaka High Court by Embassy Supermarket and Butchery Limited, Food Lovers Lusaka agreed to buy the supermarket at a cost of K841,465 and that the payment was to be made in instalments with the initial one being in the sum of K500,000.
Food Lovers was to make the payment in the sum of K341,465 for the supermarket’s equipment by June 1, 2013 and an additional payment of US$73, 318 was to be paid to Embassy Supermarket and Butchery Limited over a period of 36 months.
Following this agreement, Embassy Supermarket and Butchery Limited proceeded to dispose off its assets, borrowed money to pay terminal benefits for its workers and negotiated with the supermarket’s landlord to transfer the lease to Food Lovers.
“The defendant has failed or refused to perform or discharge its obligations, and for this reason the plaintiff has suffered loss and damage,” part of the statement reads.
In another matter, the fresh food chain has been sued by Freddy Hirsch Group Limited for breach of contract involving K309,594 when it agreed to buy various equipment for its butchery.
In a statement of claim filed in the Lusaka High Court, Food Lovers was to make the payments in six equal monthly instalments but has since failed to complete the payment.
The butchery equipment firm claims that Food Lovers has managed to make payments amounting to K465, 354 towards the purchase of the equipment which was delivered.
“The defendant has failed or neglected to pay the balance of K309,594 it owes the plaintiff. The plaintiff also claims interest to short-term deposit,” part of the statement of claim reads.
