23 year old Chipata man sentenced to 25 years for rape

THE Chipata High Court has sentenced a 23-year-old peasant to 25 years imprisonment with hard labour for having anal sex with an old woman.
Before Lusaka-based High Court judge Mwila Chitabo was Moses Phiri, who was facing charges of rape and having sex against the order of nature.
Particulars of the offence are that Phiri on October 15, last year, in Chipata, had carnal knowledge of a named old woman, against the order of nature.
In her testimony, the victim told the Chipata Magistrate’s Court, where the matter was tried, that on the material day, Phiri attacked her while she was sleeping in her house.
She said when Phiri entered her house; he lit a match stick then forced himself on her. She said Phiri had anal sex with her. She described the experience as very painful.
“I shouted for help and the accused was later apprehended and was identified as Phiri, who once worked for me at our farm,” she said.
When the matter came for judgement in the high court, Mr Justice Chitabo sentenced Phiri to 25 years imprisonment with hard labour with effect from the day of his arrest.
And in the same court, a 34-year-old Nyimba peasant was sentenced to 35 years imprisonment with hard labour for defiling a minor, aged four.
Francis Mumba, who was committed to the high court for sentencing, was charged with one count of unlawful carnal knowledge of a minor under the age 16.
Particulars of offence are that Mumba, on September 25, 2014, in Nyimba, dragged the minor in a bush where he defiled her.
The accused pleaded quilty to child defilement and Judge Chitabo said he was sentencing him to 35 years of imprisonment with hard labour to deter would-be offenders.
