The former wife of the late former president, Nelson Mandela, Winnie Madikizela-Mandela has filed papers in the Mthatha High Court in the Eastern Cape, asking it to hear her claim to ownership of the Mandela home at Qunu.
Her attorney wants the court to allow the legal battle over the Qunu property outside Mthatha to take place with immediate effect.
Mvuzo Notyesi says they’ve filed all the necessary documents regarding the case against the executors and the state.
According to documents filed before the Mthatha High Court, the executors of the late Nelson Mandela estate are cited as first respondents while the Registrar of Deeds in Mthatha and Land Affairs Minister as second and third respondents respectively.
The President of South Africa, Jacob Zuma, is fourth respondent and Nelson Mandela’s widow, Graca Machel Mandela is the 7th respondent.
Winnie Madikizela Mandela argues that in terms of the customary law, she has all the rights to own the Qunu property.
However the executors have a contrary view in terms of the civil law. The matter is expected to be heard in court soon.
