A MAN who stole a mobile phone worth K800 has been sentenced to eight months imprisonment with hard labour by the Kitwe Magistrate’s Court.
Matthews Mulenga, 21, of Chimwemwe Township in Kitwe pleaded guilty to the theft.
Principal resident magistrate Penjani Lamba, however, suspended the sentence to six months on condition that the convict does not commit a similar offence.
Particulars of the offence are that Mulenga on April 20 this year in Kitwe, stole a mobile phone valued at K800.
Magistrate Lamba said she took note of what Mulenga said in mitigation and that he was a first offender who readily admitted the charge.
“I sentence you to eight months imprisonment with hard but I have suspended the sentence to six months. Two months, you will be incarcerated, the sentence is with effect from today.
If you are not happy with my conviction, you can appeal to the High Court within 14 days.” she said.
Facts before the court are that around 10:00 hours on the material day, Mweche Ngoma was at his makeshift stall selling mobile phones.
As Mr Ngoma was attending to clients, Mulenga took advantage of the situation and stole a Samsung mobile phone and hid it.
But one of the customers who saw Mulenga picking the phone, raised alarm. However, he ran away and in the process, Mulenga dropped the phone, but he did go far as he was apprehended and taken to the police.
