Defence in the matter in which Alliance for Better Zambia-ABZ President Frank Bwalya is facing a charge of defaming President Michael Sata this morning failed to take off for the second time in the Kasama Magistrates Court.
This was after Magistrate Kelvin Soma informed the court that Principal resident magistrate Vincent Siloka who is presiding over Father Bwalya’s case is out of office.
Magistrate Soma has since adjourned the matter to 10th June, 2014.
And speaking to Mano News shortly after his case was adjourned, Father Bwalya expressed displeasure over the development.
On 1st April, 2014, defence in the matter failed to take off after Father Bwalya filed in a notice that he had engaged Sunday Bwalya Nkonde -SBN legal practitioners to represent him in the case.
Father Bwalya had told the court that his lawyers were not available as they had a criminal case in Lusaka.
On 4th March, 2014, Magistrate Siloka found Father Bwalya with a case to answer and put him on his defence.
This was after the state concluded its case by calling seven prosecution witnesses.
Facts before the court are that on 6th January, 2014 Father Bwalya defamed President Sata when he referred to him as ‘cumbu munshololwa, muwelewele, tatontokanya’ during a live Programme on Radio Mano.
Father Bwalya pleaded not guilty to the charge.
