Four Chinsali residents have been sentenced to three years imprisonment with hard labour for causing actual bodily harm by Chinsali magistrate court in Muchinga province today.
Before magistrate Shadrick Chanda were Amos Mpundu, 28, Bwalya Musata, 24, Kasonde Musataand, 20 and Gastel Musata, 29, all of Chikabala village in chief Mubanga’s area.
Facts before the court were that the four, on March 16, 2012, jointly and whilst acting together did assault, Sylvia Namonje, occasioning actual body harm contrary to Section 248 of the Penal Code Chapter 87 of the Laws of Zambia.
The four were found guilty by Magistrate Chanda following the evidence produced in court by the state.
In passing judgement, Magistrate Chanda observed that assault cases have cost a lot of lives in the district which he said must come to a stop in order to respect other human beings.
The magistrate warned that the court will not be lenient in ensuring that sanity is restored in communities.
In mitigation, Mpundu said he had nothing to plead for, claiming that he did not know anything about the case leveled against him while Musata pleaded for maximum lenience, saying he had learnt a lot while in police custody.
Meanwhile the other two counterparts Musataand and Gastel Musata had nothing to say.
Magistrate Chanda said he was sentencing the quadruple Musata to three years imprisonment with hard labour with effect from the date of arrest in order to detour other would-be offenders in future.
