THE Livingstone High Court has sent two Mazabuka businessmen to jail for 10 years each with hard labour for attempted murder.
This is in a case in which William Njovu, 23, and Iwell Njovu, 19, were charged with attempted murder and were appearing before Judge Milimo Salasini.
It is alleged that on September 9, 2012, in Mazabuka, the duo attempted to kill Garrison Chibaanga.
Facts before court are that on the material day, around 18:30 hours, at Kushiya farm in Mazabuka, the two, whilst acting together, shot Chibaanga.
The complainant sustained several cuts on the stomach caused by bullets. Chibaanga was, however, able to identify the two accused persons.
The court heard that the duo were on the run after the incident, but the complainant got hold of the gun and handed it over to the police.
Police instituted investigations and identified the owner of the gun who was, at the time, deceased, but the firearm was in the custody of the estate administrator, Nchimunya Muchindu.
When Ms Muchindu was interviewed, she explained that she gave the gun to one of the accused persons, Njovu, to have it serviced.
Njovu led police to his co-accused and the duo were subjected to an identification parade, during which process two witnesses managed to identify them.
In mitigation, the two, through their defence lawyer, Switz Mweemba, pleaded for the court’s leniency.
Mweemba said the convicts had learnt a lesson during the time they were in custody.
In her judgment, Judge Salasini took note of the mitigation, but pointed out that the offence committed was serious and attracted a maximum sentence of life imprisonment.
“As first offenders, you are entitled to leniency, and I, therefore, sentence you to 10 years imprisonment with hard labour,” she said.
