THE Ndola Magistrate’s Court has imposed a two-year jail sentence with hard labour on a man of Kawama township in Ndola for breaking into his cousin’s house and stealing a pair of shoes and a bicycle worth over K700.
Principal resident magistrate Obbister Musukwa on Monday jailed Kapembwa Chitambo, 28, after he admitted a charge of burglary and theft.
“On your own admission of the offence and the facts as being correct, I find you guilty as charged and I accordingly convict you.
“I note that you are a first offender who readily pleaded guilty to the charge, but such offences are on the rise. Hence, it is my considered view that a custodial sentence would be befitting,” Mr Musukwa said
He sentenced Chitambo to two years imprisonment with hard labour.
In mitigation, Chitambo begged the court for forgiveness because he is remorseful for his actions and vowed never to commit a similar offence in future.
Chitambo, on April 2 this year in Ndola, broke into Chishimba Sikazwe’s house with intent to steal.
Chitambo stole a pair of shoes and a bicycle, altogether worth K740.
Facts before court are that Mr Sikazwe left home on the fateful night after securing his house.
The court heard that Mr Sikazwe found that someone had broken into his house when he returned home the next morning.
Mr Sikazwe suspected that Chitambo was behind the burglary and theft and he went to Kawama Police Post to report the matter.
Mr Sikazwe later visited Chitambo’s house and found him wearing the same shoes that were stolen from his house.
Chitambo was apprehended and he led police officers to the recovery of the bicycle.-MUBANGA NONDO, ZambiaDailyMail
