Mansa Magistrate has sentenced a 48 year old man of Chembe district to 12 months imprisonment with hard labour for stock theft contrary to Section 275 (1) (a) and 272 of the penal code Cap 87 of the Laws of Zambia.
Before Magistrate George Mulenga was Willie Kalaba of Chief Kasoma Lwela’s chiefdom who stood charged for Stock theft.
Particulars of the offence where that Kalaba on March 7, 2015 in Chembe stole one goat valued at K300, the property belonging to Ruth Lwando.
In passing judgment, Magistrate George Mulenga said he took into account his mitigation that he was entitled to leniency as he admitted to the charge without wasting the court’s time but the offence he committed attracts punishment of 15 years.
Magistrate Mulenga said to deter others from committing the same offence,
he was sentenced to one year imprisonment with hard labour so that while in prison, he can reflect on his life and become a better citizen.
Meanwhile, in the same court 24 year old Melody Mwansa of Kapesha village
in Chief Kalasa Lukangaba has been sentenced to six months in each count but suspended for two years.
Mwansa was found guilty on two counts of theft contrary to section 272 Cap 87 of the Penal Code of the Laws of Zambia.
In the first count, Melody Mwansa on February 7, 2015 stole a pair of trousers and a jersey valued at K570 property belonging to Mercy Chishala while in the second count, on 28 February, 2015, she stole two pairs of trousers valued at K155 property belonging to Ngandwe Mpundu.
In sentencing Mwansa, Magistrate Mulenga said the offences she committed are very serious and theft attracts punishment of five years.
He said the convict knew she had children and didn’t think twice about them when she was stealing.
Magistrate Mulenga however, said the courts find it difficult to send women with babies to prison as they are concerned with welfare of little children who are innocent spending their time prison and therefore sentenced
