THE Kitwe Magistrate’s Court has found a 35-year-old man of Kamitondo township with a case to answer for malicious damage to property.
Magistrate Prosper Mwila placed Moses Kafwelu on his defence for allegedly causing malicious damage to Susan Banda’s Toyota Progress on October 17 this year.
When the matter came up for trial last Monday, Max Musonda, a police officer of Riverside Police Station, testified that he arrested Kafwelu on October 22 this year and confiscated catapults and stones from him.
“Your honour, I arrested the accused and I retrieved the evidence I have produced now before the court,” Mr Musonda said.
But Kafwelu, in his defence, denied damaging Ms Banda’s vehicle.
Kafwelu said he was nowhere near Kamitondo township on the fateful day because he had no reason to be there.
“Your honour, I was at a bar drinking at the time they are saying the incident happened and I was not found with any stones or catapults,” Kafwelu said.
But Mr Mwila ruled the State had proved its case against Kafwelu, which required him to be placed on his defence.
“As it is, you have not given me any point to justify your statements or to support your plea of not being guilty. Therefore, I advise that you should come with serious evidence or statement that will prove that you are innocent,” Mr Musonda said.
