Heritage Party President Brigadier General Godfrey Miyanda has withdrawn from the Presidential Eligibility case. This is in the matter were Dan Pule, Peter Chanda and Wright Musona have petitioned the constitutional court to declare that President Edgar Lungu is eligible to contest the 2021 elections.
When the matter came up on Wednesday, General Miyanda informed a panel of five judges who included constitutional court President Hildah Chibomba and her vice Mungeni Mulenga that he has withdrawn from the case. General Miyanda like the UPND, PF and the Law Association of Zambia joined the matter as an interested party.
The withdrawal of General Miyanda means that the court will not listen to the motions that he had brought to court including the one that was scheduled for ruling on Wednesday. The constitutional court will then render a ruling on the petitioners’ application for the court to reconstitute itself into a panel of seven judges on a date to be communicated to parties. But before adjourning the matter, the parties were informed that the date for hearing of the main matter will be communicated to them. On Tuesday when the matter came up, the court resolved to deal with all the pending preliminary issues in order to pave way for the commencement of hearing for the main matter.
