The Mansa Magistrate’s court has committed a 26-year-old man of Chembe District to High Court for sentencing.
This was in a case in which Chola Chibale of Kayoma village in Chief Milambo’s Chiefdom is charged with attempted rape contrary to Section 134 Cap 87 of the Penal Code of the Laws of Zambia.
Magistrate Mubanga Mulenga found Chibale guilty of attempted rape after the prosecution team proved their case.
Particulars of the offence are that Chibale on July 26, 2015 in Chembe District unlawfully attempted to have carnal knowledge of a 17-year-old girl without her consent.
Facts before the court were that the girl was going home to her village from the farm when she met Chibale along the road.
The girl testified in court that Chibale was admiring her legs and forced himself on her telling her he would marry her if she got pregnant and was only rescued by people in the oncoming vehicle.
Chibale was then arrested by members of the Community Crime Policing Unit and was taken to Mansa Police station.
Magistrate Mulenga committed Chibale to the High Court for mitigation and sentencing, saying that the case in question is outside the jurisdiction of the magistrate court as it attracts a minimum of 25 years.
