THE Kitwe Magistrate’s Court has sentenced a 42-year-old man of Kitwe to 12 months imprisonment with hard labour for breaking his friend’s arm with an axe.
In this case, Patrick Insonga of Kitwe’s Kwacha township was facing
one count of assault, contrary to section 248 of the Penal Code, chapter 87 of the Laws of Zambia.
On August 3, 2015, in Kitwe, Insonga did assault Mubanga Chileshe, thereby occasioning him actual bodily harm.
In his judgment, magistrate Chinunda Chiwaula said the prosecution managed to prove a case against the accused, and he therefore found him guilty as charged and convicted him accordingly.
“I sentence you to 12 months imprisonment with hard labour with effect from the date of your arrest. If you are not happy with what I have done, you can appeal to the High Court within 14 days,” Mr Chiwaula said.
During trial, the complainant testified that on the material day, his friend went to him and told him that he had embarrassed him in front of people while they were drinking beer.
The court heard that it was at this point that the convict got upset and hit the complainant on the left arm with the handle of an axe. The arm got broken.
Later, the matter was reported to the police, where the convict was charged and arrested with the subject offence.
