THE Kitwe Magistrate’s Court has sentenced a 27-year-old man of Kitwe to 100 days imprisonment with hard labour for stealing 20 bottles of beer.
This is in a matter in which Misheck Mwanza of house number 2120 Buchi Township in Kitwe, pleaded guilty to one count of theft contrary to section 267 and 272 of the Penal Code chapter 87 of the Laws of Zambia.
Mwanza told Magistrate Ruth Kapulo that he stole the bottles of beer because he wanted to drink the alcohol.
Mwanza stole the 20 bottles of beer from Brian Limbikani On July 7 this year, in Kitwe.
In mitigation, Mwanza pleaded with the court to exercise maximum lenience as he was a first offender.
But in her judgment, Magistrate Kapulo said she was satisfied with the facts presented before her and sentenced Mwanza accordingly.
“Upon your own plea of guilty and admission that the facts are true and correct, I find you guilty as charged and I convict you accordingly. I sentence you to 100 days imprisonment with hard labor, with effect from today and if you are not happy with what I have done, you are free to appeal to the High Court within 14 days,” Magistrate Kapulo said.
Facts read in part before the court were that on the fateful night around 20:00, the complainant was at his residence and that whilst home, he received a phone call from his caretaker at the bar within Nakadoli Market that he had apprehended Mwanza for stealing beer.
The court heard that the convict was later taken to the police where he was charged and arrested with the subject offence.
