THE Serenje High Court has jailed a 41-year-old man for 25 years with hard labour for defiling his stepdaughter.
Pethous Chibuye was arrested on April 8, last year, and was charged with defilement of a child under the age of 16.
Kabwe High Court judge-in-charge Dominic Sichinga slapped the custodial sentence on Chibuye when the matter came up before him for sentencing on Tuesday.
Mr Justice Sichinga said the court was disappointed with Chibuye for the offence he had committed because, as a father, he was in a position of trust and was expected to take care of his child.
In mitigation, Chibuye said he had eight children under his care who would suffer if he was jailed.
Mitigating for Chibuye, Legal Aid Board lawyer Kamo Simfukwe said the convict was a first offender, and was pleading with the court to exercise leniency.
Particulars are that the convict, on unknown dates between September 1 and October 31, last year, had unlawful carnal knowledge of a child under the age of 16, contrary to the Laws of Zambia.
In passing sentence, Mr Justice Sichinga said it was disappointing that a father destroyed the life of his daughter.
“I have considered your mitigation as you are a first offender and you are entitled to leniency. I will exercise my leniency on you,” Mr Justice Sichinga said.
He told Chibuye that the court saw it fit to sentence him to 25 years imprisonment with hard labour.
