AN unusual occurrence was heard in the Lusaka Boma court when a 35-year-old man of Lusaka’s Kaunda Square decided to divorce his wife after learning that she initially had an intimate relationship with his younger brother.
Noble Banda told Principal Presiding Magistrate Mable Mwaba, Senior Court Magistrates Dennis Mpundu and Miyanda Banda that he could not marry Gloria Simate, 26, because she initially had a relationship with his brother.
“She kept such a big thing from me from the time we were dating. I came to know about it when introducing her to my family.When my sisters saw her they told me that she had dated my brother sometime back,” he said.
Banda told the court that his brother admitted having had an intimate relationship with his wife.
“Your honour, when I asked Simate about the relationship with my brother she told me that they were just good friends. This is the reason I can’t go ahead with this marriage, I want a divorce,” he said.
Banda told the court he wanted a refund of K4, 000 which was the initial payment towards the K10, 000 bride price.
Banda’s brother, Kennedy also admitted before court that he initially shared a relationship with Gloria.
Earlier in her statement, Simate told the court that she dated Banda from 2006 to 2014.
Simate said after Banda paid part of the bride price he disappeared and cut off communication with her or her family.
“One day, I received a text message from him saying that he had called off the marriage without giving me a reason. He only said he would send his family to collect the part payment made towards the bride price,” she said.
Simate told the court that she also wanted a divorce and to find out why Banda wanted the bride price back.
Passing judgment, the court granted the couple divorce and ordered Simate’s family to only pay back K2,000.
