Attorney General Likando Kalaluka has told the tribunal probing suspended Director of Public Prosecution Mutembo Nchito that the state is in a hurry to conclude the sitting of the tribunal.
Mr Kalaluka says this is why the tribunal must not entertainMr Mutembo Nchito’s arguments that are outside the tribunal’s mandate.
This was after Mr Mutembo Nchito said that the terms of reference before the Tribunal are incompetent and can not be used to remove him from Office.
Mr Mutembo Nchito also asked the tribunal to hear his matter in the public.
When asked to comment on this issue, Attorney General Likando Kalaluka said the state had no problem with the tribunal being held in public but that there was a precedence of the tribunal probing a former DPP that was held in Camera.
Mr Mutembo Nchito further said in the submission, that he is not comfortable with Justice Ernest Sakala and Justice Mathews Ngulube, who are tribunal members.
He therefore demanded that the two recuse themselves from the matter.
The Tribunal has since adjourned and is expected to resume this afternoon at which the state is expected to reply toMr Mutembo Nchito’s submission.
