Cannabis farmer fined
Samfya, March 17, ZANIS———A Samfya Magistrate Court has fined a 28-year-old man of Mansa K6, 000 or in default save nine months imprisonment with hard labour for cultivating cannabis contrary to Section 9 of Narcotic Drugs Act, Chapter 96 of the Laws of Zambia.
Before Magistrate Mambwe Kanunka was Joseph Lwando of Kalenge Village in Chief Mibenge’s Chiefdom in Mansa district of Luapula Province.
Lwando was arrested on February29, 2015 by the Samfya Drug Enforcement Commissioners (DEC) officers during an operation in Samfya.
Facts before the court were that Lwando, on February 19, 2015, in Samfya district, without lawful authority did cultivate plants namely, cannabis weighing 120 Kilograms.
Preliminary tests were conducted on the said substance and tested positive Cannabis Sativa.
In mitigation Lwando pleaded for lenience, saying he is a married man with four children and taking care of his two young sisters.
But in passing judgment, Magistrate Kanunka said she was being lenient on the accused person by fining him with K6, 000 or nine months imprisonment with hard labour when the offence in question carries the
minimum of ten years and above for the first offender.
