–Katete Magistrate Simushi Mwakoi has fined Movement for Multi-Party Democracy Mphangwe Ward Councilor for authorizing a nuisance.
Appearing before Katete Magistrate today was Mphangwe Ward Councilor Vincent Mbewe aged 50, of Riverside Compound who pleaded guilty to one count of authorizing a nuisance.
This was after he urinated in a public place without provision of sanitary facility contrary to section 64 of the public health Act cap number 295 of the drainage and latrine regulations cap 78 of the laws of Zambia.
Particulars of the offence are that Councilor Mbewe on October 28 did author a nuisance by allowing a dwelling to be occupied without provision of sanitary facility.
This came to light after officers from Katete District Council department public health took an inception.
In mitigation Mr. Mbewe told court that the house in question was still under construction.
However Magistrate Mwakoi reminded Councilor Mbewe that he had no authority to allow any person to occupy the building without sanitary provisions.
The magistrate stressed that government is concerned with the health of all citizens adding that the offence committed was endangering the life of the occupant.
Magistrate Mwakoi therefore slapped a 150 Kwacha fine or nine months imprisonment in default.
Meanwhile a tenant of Chibolya compound has also been fined a 150 Kwacha for occupying a house without sanitary facility.
Musonda Chipingili 31, a shoe Mender who pleaded guilty to an offence of authorizing a nuisance by allowing a dwelling to be occupied without provision of sanitary facility contrary to section 64 of the public health Act cap number 295 of the drainage and latrine regulations cap 78 of the laws of Zambia.
Musonda told court that it was unfortunate that he had to pay despite him being the tenant.
He told court that he did not know that the house did not have a toilet as he shifted in the night and only realized the following day.
He explained that he communicated to the landlord in Lusaka who promised to solve the situation but that nothing has happened yet.
