A 42 year old businessman of Siavonga was yesterday sentenced to three years imprisonment with hard labour for assaulting his wife.
Before Siavonga magistrate’s court Bartholomew Kaongo was Felix Simukole of Kanyelele compound who stood charged with one count of assault contrary to the laws of Zambia.
Particulars of the offence were that on the 4th April, 2014 Simukole who owns Nsanjemuleke tavern at Kanyelele market did assault his wife Violet Musunga following a domestic dispute.
Simukole pleaded guilty to the charge when the matter came up for plea.
He said he beat and assaulted his wife because she was not listening to his demands.
The court heard that Simukole who earlier on the night of 4th April reportedly was caught having sex with another woman in Mitcho compound, went home around 01:00 hours where he woke up his wife and demanded for sex.
It was heard that after his wife refused to have sex with him, Simukole got annoyed and started beating her using a stool and slapping her on the face until she fainted.
The court heard that whilst his wife had fainted, Simukole took the advantage of the situation to have canal knowledge of her.
However the following day, the wife reported the matter to Siavonga police who later arrested Simukole and charged him with assault case.
Magistrate Kaongo said the court had found the accused person guilty upon his admission of the charge.
In mitigation, the accused asked for courts to have lenience saying he was married with six children adding that if sent to jail his children would suffer.
However Magistrate Kaongo said in his ruling that he understood what the accused had said in his mitigation but the offence he committed was a serious one which attracts a maximum sentence of up to five years.
He said since the accused was a first offender and considering what he said in mitigation, he decided to give him a three years jail as a deterrent punishment.
