Court sentences man for theft
Livingstone, January 29, ZANIS——-A 20-year-old man of Sikute village in Kazungula district in Southern province has been sentenced to three years imprisonment with hard labour on two accounts of house breaking and theft.
This is in a case in which Livingstone Resident Magistrate Chinkanshi Chilingala jointly charged Mukena Gaula, 20 and Kabanji Mutukwelwa with house breaking and theft contrary to section 301(a) and 272 of the penal code of the laws of Zambia.
In count one particulars are that on January 18 this year, Mukena and Mutukwelwa jointly and whilst acting together did break into the dwelling of Levy Muchimbula with intent to steal and did steal t-shirts, two pairs of trousers and one short all together valued at K123.00.
Then in count two on the same day they did break into another house belonging to Danny Chimanya and stole one home theatre, one DVD player, one cell phone, one handbag, cash and assorted documents all valued at K1, 480.00.
In mitigation Gaula, showed remorse and asked for forgiveness from the court.
In passing judgment, Magistrate Chalingala exercised leniency as the accused was a first offender and he sentenced him to three years imprisonment with hard labour.
However, for Mutukwelwa the matter was adjourned to a later date for commencement of trial.
