– The tribunal appointed to probe Justice Minister Wynter Kabimba today subpoenaed Leonard Banda, the Patriotic Front (PF) losing candidate for Petauke Central constituency in Eastern province, to appear before it on 30th January 2014 to testify in the ongoing tribunal.
Tribunal chairman Evans Hamaundu, who is Acting Supreme Court Judge, sitting with two other Judges Getrude Chawatama and Justine Chashi, said his tribunal was analyzing whether Kabimba had breached both the republican constitution and the parliamentary and ministerial codes of conduct.
Justice Hamaundu noted that at this stage, it was important to call witnesses in the case and one of them is Banda, the Patriotic Front (PF) losing candidate for Petauke Central constituency in Eastern province.
Mr. Banda was also availed the letter where Mr. Kabimba sought legal opinion from the Solicitor General Musa Mwenye on behalf of the Patriotic Front (PF).
The letter was also copied to Acting Chief Justice Lombe Chibesakunda and President Michael Sata for administrative purposes.
The respondent, Mr. Kabimba was however not present in court today.
His lawyer informed the court that he was attending a funeral of his late sister but would be available in the next sitting on Thursday this week.
The tribunal is investigating Mr. Kabimba for alleged abuse of office and breach of oath of secrecy when he used a government legal opinion and tried to influence the Supreme Court to pursue a private agenda of the ruling party, the PF.
