This is a case in which David Mumba of house number 4513, Ipusukilo in Kitwe, is charged with defilement.
The offence is contrary to Section 138 of the Penal Code Chapter 87 of the Laws of Zambia as read with Act number 15 of 2005 and Act number two of 2011.
Particulars of the offence are that Mumba on August 16, 2013 in Kitwe, had unlawful carnal knowledge of a girl under the age of 16.
When the matter came up for plea before magistrate Denson Muchaba on Tuesday, Mumba denied the charge.
The girl testified that on the material day, her parents sent her to buy groceries at Kapoto Market and on her way back, she met Mumba.
The girl testified that Mumba allegedly told her to go to his house so that he could send her to buy airtime for him.
She narrated that after leaving the groceries her parents sent her to buy, she went to Mumba’s house and found him alone but that he did not give her money to buy airtime.
“He took a piece of cloth and used it to cover my mouth and he got a rope and tied my hands, he took his clothes off and then he did ‘bad manners’ to me,” the girl recalled.
The girl narrated that she told her aunt that Mumba had sex with her and the matter was reported to the police.
Mr Muchaba adjourned the case to November 4, 2013 for continued trial.
