Ndola cattle rustler caged for five years
Ndola, February 27, 2013 ZANIS……….The Ndola magistrate court has sentenced a 26 year old man to five years imprisonment with hard labour for stealing a cow.
Appearing before Magistrate Bubala Sikalunda was Mike Bwalya of Kamalasha compound in Sakania who was charged with theft of stock contrary to section 275 chapter 87 of the penal code of the laws of Zambia.
Facts of the offense are that on 8 February 2013, Bwalya took cattle belonging to Josephat Tembo for grazing in the morning and only brought them around 17 and Tembo did not bother to count them.
When Tembo counted the cattle the following the morning, he found that one animal was missing. It was then he reported Bwalya to police who later found him selling the carcass in Chifubu.
In mitigation, Bwalya pleaded that he be sent to Mpika prison as he had no relatives in Ndola.
Magistrate Sikalunda said that the court had heard the mitigation and taken into account that he was the first offender and had accepted the offence.
she however said that stock theft is a serious offence and the minimum sentence is 5years and that he did not have the luxury to choose which prison whether near his relatives or not.
