-The Samfya Magistrate Court has convicted a Lunga District Council Accountant Brian Bwale pending sentencing for theft by Public servant of public funds amounting to KR 71,258.
Before magistrate Timothy Daka was Bwale who stood charged for theft by public servant contrary to section 272 and 277 of the penal code of chapter 87 of the laws of Zambia.
Particulars of offense are that between the 21st Day of December 2012 and 4th Day of January 2013 in Samfya District of the Luapula province of the Republic of Zambia Bwale, being a public servant to the Lunga district Council did commit the offense.
The statement of facts are that Bwale as an Accounts Officer of the Lunga District Council did steal over K71, 000,000( Million-old currency) cash money which came into his possession by virtue of his employment, the property of his employer, the Lunga District Council.
Meting out the conviction, Magistrate Daka ordered that Council Secretary Oswell Mpofu and his un named treasurer to be present in court to confirm if in admittance of the charge how much of the said public funds had been recovered from Bwale.
The Magistrate reserved the matter for sentencing to a later date.
And in mitigation Bwale pleaded the courts leniency saying he had learnt a lesson and had a family to look after and would never involve himself in similar acts.
However magistrate Daka sustained Bwale’s remand to prison pending sentencing.
