THE Lusaka Magistrate’s Court has dismissed an application by Rainbow Party secretary-general Wynter Kabimba and The Post editor-in-chief Fred M’membe to acquit them or refer to the Constitutional Court the case in which they are charged with defaming former President Rupiah Banda.
Kabimba, M’membe and The Post are jointly charged with two counts of contempt of court and defamation.
The trio contended that they should be acquitted because Mr Banda’s immunity was restored by the Lusaka High Court through a consent order and that a person restored with his or her immunity cannot participate in any criminal proceedings.http://epaper.daily-mail.co.zm
