A CHINGOLA Magistrate’s Court has convicted a 19-year-old man of Chingola of defilement and committed him to the High Court for sentencing.
The offence carries a minimum sentence of 15 years in prison.
David Chomba of E20 Loop area in Chikola township was arrested earlier this year in the court premises after being acquitted of a similar offence.
On unknown dates but in April this year, Chomba had unlawful carnal knowledge of a girl aged 14 contrary to the laws of Zambia.
When the matter came up for trial, the girl testified before magistrate Joseph Malabo that on the fateful day, she was home alone when Chomba came and had sex with her.
She told the court that she is usually alone at home because her mother usually goes to a bar to drink beer.
She told the court that Chomba entered the house and forced himself on her.
The girl said she called for help but no one heard her because the houses are far apart.
She narrated that she failed to tell anyone about what had happened to her and only disclosed the sexual attack after she started experiencing abdominal pain and was taken to the clinic where she was diagnosed with a sexually transmitted infection.
In defence, Chomba said he did not know anything about the case and denied knowing the victim.
Mr Malabo found him guilty and convicted him.
“It is not in dispute that you know each other very well contrary to what you had said and looking at the girl, no one can dispute that she is less than 16,” he said.
He said Chomba had not challenged the girl’s testimony.
“I am satisfied that an offence was committed and you are the one who committed it. I, therefore, find you guilty and commit you to the high court for sentencing,”Mr Malabo said.
