A 12 year old girl of Kapisha primary school of Luwingu district testified before the Luwingu subordinate court how her class teacher defiled her in the staff room.
This is in a matter in which Brian Musonda 25 of Maiteneke village in Chief Chipalo’s area of Luwingu district of Northern Province is facing one count of defilement contrary to section 138 (1) chapter 87 of the laws of Zambia.
It is alleged that Musonda on unknown date but between 25th October and 31st October 2015 had carnal knowledge of his 12-year-old grade five pupil in the staffroom after all the teachers had knocked off.
The girl told Magistrate Davy Simfukwe that her teacher started by touching her breasts while dancing from her back and later told her to undress and had sexual intercourse in the staff room and also in her class room.
And when asked why she did not shout for help during cross examinations, the girl narrated in Bemba that Mr Musonda pleaded with her saying girls like her Mr Musonda had sexual intercourse with did not cry.
“Mwali njebele ati nilila pantu abanandi abo mwale ulungana nabo tabalelila. Nishi namunjikata pakanwa. You told me not to cry because my friends you had sexual intercourse before did not cry while you were holding my mouth,” she explained.
And other state witness, the mother to the girl Vivian Chileshe testified that she saw her daughter crying when she was coming from school and asked her why she was crying. The girl narrated that her teacher had defiled her twice in the staff room and class room.
Mrs Chileshe later rushed her to the district hospital where she was advised to report the matter to the police so that she is given a medical report.
At the police she was given a medical report and took it to the hospital were the hospital authority started administering treatment while police followed Mr Musonda and apprehended him.
Mrs Chileshe further explained that Mr Musonda was tested for HIV there at the hospital and was discovered positive which lead the hospital to start administer HIV drugs which her daughter will be taking for 15 days.
A third witness, the school teacher, Harry Chanda Chalwe told the magistrate that the girl had also reported to him about the defilement case the following day in the morning.
Mr Chalwe gave a chair to the girl so that she could explain the ordeal whilst sitting but the girl failed to sit and instead she went closer to him and explained what had transpired.
Mr Chalwe told the court that Mr Musonda confirmed having sexual intercourse with the girl and pleaded with the head teacher not to report the matter to the police.
The matter was adjourned to 5th November for continued trial.
Meanwhile Mr Musonda was remanded in Luwingu state prison.
