Widow ordered to vacate late husband’s house after being impregnated by lover

A 36-year-old woman has been ordered by a Local Court in Lusaka to vacate the house of her late husband after she was impregnated by a man who wants to marry her.
Before Senior Presiding Magistrate Daniel Phiri sitting with Magistrate Ackim Phiri at Kanyama Local Court was Ruth Nalumino of old Kanyama compound who was sued by her sister in law, Mary Imasiku, 55, of Chazanga compound in her capacity as an administrator of her late brother’s property.

 

Imasiku told the court that her brother died in 2004 and left two children, adding that she decided to sue Nalumino because she has been impregnated by another man who planned to marry her.
In cross-examination, Imasiku said that by law, Nalumino was supposed to shift to her new husband’s home.

 

 

In defence, Nalumino said that she did not refuse to vacate the house but needed time to prepare herself before leaving. Her father-in law then gave her up to September 15.
Nalumino said that the man who impregnated her paid dowry and that she was likely to leave on September 30.

 

 

Magistrate Daniel Phiri said Nalumino was supposed to thank the relatives of her late husband for letting her stay in the house.
He said she should also have told them about her new status. He ordered her to vacate the house before October 15.

  1. Thats the rule you get pregnant from someone else you vacate the house simple and straight forward
