Man beats landlord for evicting him

A 42-YEAR-OLD man of Kitwe, who allegedly assaulted his landlord when he decided to evict him for non-payment of rent, has been convicted and given an 18-month sentence suspended for two years.
Magistrate Prosper Mwila found Godfrey Mwelwa of Chamboli township, guilty of assault.

 

However, Mr Mwila suspended the sentence for two years on condition that the convict does not commit a similar offence within the said period.
He also ordered Mwelwa to compensate the complainant K750 or in default face 18 months imprisonment with hard labour.

 

In his judgment, magistrate Mwila said the state managed to prove their case against the accused.
“I have noted that there are aggravating circumstances in the manner in which you committed the offence. You followed your landlord to his house and you starting slapping and kicking him.
“I sentence you to 18 months imprisonment with hard labour, but I have decided to suspend the sentence to two years on condition that you do not commit a similar offence and that you compensate the complainant K750,” he said.

 

Mwelwa, on July 15, this year, in Kitwe, allegedly assaulted Mutale Chimfwembe, thereby occasioning him actual bodily harm.
During trial, Mr Chimfwembe told the court that he owns a house in Chamboli which Mwila was renting.
He said Mwelwa did not pay him rentals for the month of June this year, and therefore he found a new tenant for the house.

 

Mr Chimfwembe said on the day in question, a prospective tenant went to inspect the house but this angered Mwelwa who followed him to his house. He said the convict kicked and slapped him until he sustained injuries.
The matter was reported to the police where Mwelwa was charged and arrested.
