THE Kitwe High Court has ordered the immediate arrest of a security guard of Kasempa in North-Western Province for calling a businessman a wizard.

 
Kitwe High Court Judge Catherine Makungu, sitting in Solwezi, ordered the arrest of Morgan Mwelumuka to serve his eight months jail sentence after he failed to show up in his appeal case without any official communication to the court.
Mwelumuka, 49, was convicted by the lower court for calling a Kasempa businessman a wizard.

 

He was accused of calling Kazadi Kaulume, owner of a shop known as ‘Biso na Biso’, a witch on March 28, last year, during the funeral of a Kasempa resident.
Mwelumuka was convicted for the offence and sent to jail for eight months imprisonment, but he appealed against the verdict in the High Court.

 

But when the matter came up before the High Court, Mwelumuka and his lawyers absconded from court, prompting Judge Makungu to order for his arrest so that he could serve his jail term.
Ms Justice Makungu noted that for no apparent reason, the appellant and his advocates, did not follow up the matter and she was therefore convicting him to serve the jail sentence.

 

“I order to apprehend the said Morgan Mwelumuka and convey him to Kasempa State Prison to serve his sentence of eight months imprisonment with hard labour imposed on him by the lower court,” she said.
Justice Makungu said a bench warrant for Mwelumuka’s arrest was being issued immediately.
