THE state has agreed with former President Rupiah Banda to discontinue an appeal in which it challenged a High Court decision to allow Mr Banda to commence judicial review into Parliament’s decision to lift his immunity.
According to a consent order in the Supreme Court, the Attorney General and Mr Banda’s lawyers agreed to withdraw the appeal.
On April 12, Lusaka High Court judge Annie Sitali allowed Mr Banda to commence judicial review but refused to stop criminal proceedings against him in the lower court.
Mr Banda is asking the court to nullify Parliament’s decision to lift his immunity.
Mrs Justice Sitali stopped proceedings into the judicial review to allow the Supreme Court deal with the appeal by the state.
