Woman sentenced for ‘dirty’ trespassing

THE Kabwe Magistrate’s Court has committed a 22-year-old woman of Kabwe to one month community service for defecating in another woman’s house.

 

Cleopatra Mulele, of house number MD114, Makululu township, was charged with one count of trespassing with intent to commit an offence and to annoy.
Mulele appeared before Kabwe magistrate Sebastian Mwenya when the matter came up for judgment.

 

“I have gone through the evidence given by the court and am satisfied with this evidence. I find the accused guilty and convict her accordingly,” Mr Mwenya said.
Mr Mwenya said the prosecution had proved its case beyond reasonable doubt against Mulele.
On March 31, this year, in Kabwe, Mulele unlawfully entered in the house of Margaret Nachamba with intent to commit an offence, namely to annoy.

 

Mr Mwenya said it is not in dispute that someone defecated in the house and that Mulele was found in the act.
During trial, Ms Nachamba testified that on the material day, around 06:00 hours, she went to fetch water and upon returning, she found Mulele defecating in her house.
“When I asked her who she was, and where she came from, she did not answer me, but later told me her name is Cleopatra,” Ms Nachabma said.

 

The complainant told the court that she pushed Mulele out of the house and alerted members of the public, who reported the matter to the police.
In mitigation, Mulele told the court that she is a first offender who is married with one child under her care.
“I am asking for forgiveness because I have never done such a thing before in my life,” Mulele said.
Mr Mwenya told Mulele that her actions were very shameful.
“You are a married woman, you should not behaviour in the manner that you did, exposing yourself in such a way to the public,” Mr Mwenya.
