Kitwe man 25, jailed 3 years for attempting to rape a 35 year old woman

THE Kitwe Magistrate’s Court has sentenced a 25-year-old peasant to three years imprisonment with hard labour for attempting to rape a 35-year-old woman.

 

Senior resident magistrate Daniel Musonda, last Friday jailed Aaron Mulenga of plot number 8, Mikasa farming area, in Kitwe, who was charged with one count of attempted rape.
Particulars are that on March 1, this year, in Kitwe, Mulenga attempted to have carnal knowledge of a named woman without her consent.
In his judgment, magistrate Musonda said he was satisfied with evidence from the State witnesses that the convict had intentions to rape the woman when he removed his clothes and hers.

 

He observed that the complainant described before court how Mulenga attempted to rape her, and that she shouted for help.
“There is overwhelming evidence that the convict went to the house of the victim. And I have doubt in what he said that he went to her house in the night so that he could pay back the money he owed her.
“From the foregoing, I am satisfied that the prosecution managed to prove a case against the convict and I find him guilty accordingly. I sentence you to three years imprisonment with hard labour. And if you are not happy with my conviction, you can appeal to the High Court within 14 days,” he said.

 

During trial, the woman testified that on the fateful night, around 21:00 hours, she was at her house in the farming community when Mulenga went and grabbed her.

 

The court heard that the convict then took off the woman’s underwear and undressed himself, too.
In the process of this, the victim shouted for help and members of the public came to her rescue and apprehended the suspect.
The matter was reported to the police and Mulenga was arrested and charged with the subject offence.
