A MINOR has told the Chingola Magistrate’s Court that her defiler masked his face with a cloth while he had carnal knowledge of her.
The girl was testifying before magistrate Shadreck Chanda in a case where a 17-year-old boy of Kapisha in Chingola is charged with defilement of three girls aged between 6 and 8.
One of the victims testified to the court that the named boy had sex with her after he sent her friends to go and buy fritters.
“He sent my friends to go and buy fritters and told me to remain behind. He then undressed me and had sex with me. When my friends came back, he sent me with my friend to go and buy ice block, then he remained with my other friend,’’ one of the victims said.
This is in a case where the juvenile is facing three counts of defilement, contrary to the Laws of Zambia.
Particulars of the offence are that on April 23, this year, in Chingola, the suspected juvenile offender had unlawful carnal knowledge of the three girls under the age of 16.
The court heard that the suspect threatened to throw stones at the victims if they ran away.
Narrating the ordeal, one of the minors told the court that the accused covered his face with a cloth before having sex with her.
The girl said she is unable to walk properly since she was defiled.
Magistrate Chanda adjourned the matter to a later date for judgement.
Meanwhile, Chingola magistrate Joseph Malabo has set June 30, 2015 as the day of judgment in a case where Chingola businessman Leonard Mulenga, 39, is accused of defiling a girl below the age of 16.
Mulenga, of Nchanga North and popularly known as ‘Bonta’ by the locals, pleaded not guilty to defilement and was found with a case to answer and put on defence.
“Your honour, the girl lied that I defiled her because she didn’t want to be arrested for theft,” Mulenga said during his defence.
He said the complainant, in the company of other girls, asked for a lift but when he dropped them, he discovered that his four mobile phones were missing from the car.
“Your honour, as I tried to stop them from going away, they ran away, but I managed to get hold of one of them, whom I took to the police station. When she realised that she would be remanded in custody for theft, she lied that I defiled her,” Mulenga said.
Particulars of the offence are that Mulenga, on February 18, 2015, in Chingola, had unlawful carnal knowledge of a girl under the age of 16 in a car at Chingola Arts Society.
