A 17-YEAR-OLD pupil of Kalomo Secondary School, facing a charge of defilement, has told the Livingstone Magistrate’s Court that he had sex with a girl aged 12 because she consented.
It is alleged that on May 1 this year, in Livingstone, the boy in question had unlawful carnal knowledge of a girl under the age of 16.
The juvenile pleaded guilty to defilement before magistrate Benjamin Mwelwa, but said the act was consensual.
Testifying in court, the accused said he was going home when he met the girl, who was going in the same direction, and he approached her over his intention to have sex with her.
“Your Worship, I admit the charge. I found her on the road and I talked to her and I asked her where she was going. And it turned out that she was going in the same direction as me.
“I accosted the girl and she gave me permission after I made a sexual proposal to her. She did not refuse my proposal. That is how we went on to have sex,” he said.
The juvenile, however, admitted that the girl was a child and he does not know what came over him when he had carnal knowledge of her.
“I didn’t know what I was doing when I made love to her. I don’t have demons but I just thought that people would not know about what had transpired,” he said.
Magistrate Mwelwa adjourned the case to allow officers from the Department of Social Welfare to assess the matter.
